TERMS AND CONDITIONS (please read carefully) 

Interpretation 

The ”Student¨ or “Applicant” means the individual who signs this contract and agrees to be bound by its terms and includes a guardian of that individual if the individual is under 18 years of age.

The Student hereby agrees to be bound by the terms of this contract with Nakama Brazilian Jiu Jitsu and the persons named and described in Schedule 1, hereinafter jointly and severally referred to as (“the providers”). The providers agree to permit the Student to use their premises and facilities for Martial Arts purposes, to instruct the Student Brazilian Jiu Jitsu (“BJJ”) specific training or other Martial Arts (¨the training¨) upon and subject to the following terms and conditions: 

Clause 1 - Academy fees 

1.1 The Student will pay on demand the prescribed or stated fees for the service. Such fees may be notified to the Student by letter, email, or memorandum or by notice displayed in the provider’s premises or premises occupied by the provider or verbally. Payments will continue to be deducted from the student’s nominated account after the minimum period until written notice is given by the Student to either cease or suspend training for an agreed specified period. If payment is declined, an additional $15 will be added to fees for each default to cover any administration, dishonour, or other bank fees. 

1.2 Cancellation requests require 2 weeks written notice. Fees may only be put on hold by written request if and when a medical certificate shows that the Student is unable to train for medical reasons only. There is a maximum suspension period of 3 months (13 weeks) allowed per 12-month period. If the suspension period exceeds 3 months, the membership may be cancelled, and the Student may need to reapply for membership at the rates assigned at the time of the new application. 

Clause 2 - Medical condition and indemnity clauses 

2.1 Prior to the Student engaging in BJJ and other Martial Arts training on the premises, the Student agrees to and must notify the Instructors of any prior or existing  medical condition or injury whether the Student is pregnant or suspects the Student is pregnant, or is otherwise aware of any condition or circumstance that would  make the Student's participation in BJJ and other Martial Arts training dangerous for the Student and/or any other participants or likely to cause harm to the Student  and/or any other participants. 

2.2 Upon signing this contract, the Student releases and discharges the Instructors, their officers, servants, agents and employees (the releasees) from any and all  causes of actions, claims, demands, suits, liability, costs, accounts and proceedings whatsoever and howsoever (whether at law or in equity), including for loss and  damage in respect of personal injury, death or damage to property, that the Student may now or at any time may have but for the entry into this contract could or might have had against the releasees arising out of Student’s participation in BJJ or other Martial Arts training. 

2.3 By entering into this contract, the Student hereby holds the Instructors and BJJ and any Martial Arts performed on the premises and their officers, servants, agents and employees (the releasees) harmless and indemnifies the releasees from any and all liability for any property damage or injury to any third party resulting from the Student’s participation in BJJ or other Martial Arts training. 

Clause 3 - Martial Arts done at applicants own risk 

Assumption of Risks  

By entering into this contract, the Student acknowledges that the student is aware that training BJJ involves risks, dangers and hazards, including, but not limited to:  the possibility of injury, worsening of an existing medical condition or injury, or death. By entering into this contract, the Student declares that the Student freely accepts and fully assumes all such risks, dangers and hazards and the possibility of injury, worsening of an existing medical condition or injury, or death, property damage or any loss resulting therefrom. 

Clause 4 - The Student's responsibility to follow instructions 

By entering into this contract, the Student agrees to and warrants that the Student will follow the instructions of BJJ Instructors at all times and in the event that the Student feels any pain or discomfort or suffers any injury during BJJ training that the Student will notify the Instructors as soon as possible. Should the Student fail to observe and/or follow the instructions of the BJJ Instructors, the Instructors have full discretion to deny the Student from continuing their training. 

Clause 5 - Exclusion of applicant 

The Applicant warrants that the student has not at any time been excluded from Martial Arts by a medical practitioner or any person or entity including a Martial Arts Club.  

Clause 6 - Governing law 

Any agreement entered into pursuant to this contract is to be governed by the laws of the State of Victoria and subject to exclusive jurisdiction of Courts of Victoria.

Clause 7 - Statement of understanding 

I, the Applicant, have read or have had these terms and conditions read and explained to me. Accordingly, I accept to be bound by these terms and conditions.

Schedule 1 

In addition to Nakama Brazillian Jiu Jitsu, the providers in respect of this agreement include:

Nakama BJJ Guidelines 

Uniform

• For our Gi class any colour Gi may be worn as long as it is clean and washed.
• A rashguard is to be worn underneath the Gi.
• For Nogi please ensure shorts with no pockets and rashguards are worn. 

Mat 

• Please shake all your training partners hands upon entering the mat and before leaving when you go home. 
• Ensure you remove footwear upon entering the mat and wear footwear when off the mat at all times. 
• Remove all jewellery and piercings before stepping on the mat. 
• Look after your training partners, this should always be your priority.
• If you are rolling near others or the edge of the mat, please stop and reset. 
• NO jumping guard, kani basami (scissor takedowns) or tani otoshi (side sacrifice throw with or without body lock) will be tolerated. Majority of injuries are due to uncontrolled falling body weight landing on your partner, not submissions. 
• NO heel hooks for white belts or on white belts. 
• Please do not speak while the instructor is teaching as this causes disruption to the class flow. 
• If you need to leave the mat during a class, please inform your instructor before doing so. 

Hygiene 

• Nails are to be trimmed and hair is to be tied up.
• Please wash your apparel after every class. 
• Please ensure any cuts/wounds, abrasions, grazes (including mat burn), rashes etc are covered well and if needed enforced with strapping tape in order to protect others. 
• If any discolouration/redness, swelling, pain, oozing, abnormalities etc appear, please obtain clearance from your doctor before training, due to conditions such as staphylococcus. 
• Bring a gym towel if needed.

General 

• Please check in upon entering the gym.
• Leave things as you found them, if you make a mess please clean it up and put any rubbish in the bins provided.
• When using the strength equipment please return items to racks/storage once finished.
• Please do not flush anything, but toilet paper down toilets.
• When watching kids or adults classes (not participating) from sidelines, please ask for permission before coming onto the mat. 
• No screaming or talking to students from sidelines will be tolerated. 

Privacy 

• Please do not take photos during kids class, unless consent from all parents/guardians is obtained. 
• As a parent/guardian, if you take a photo of your child, please ensure consent from the parent is obtained if other children are present in the photo.
• During adult classes please ensure you have consent from others and your instructor to take photos and post to social media.

Waiver and Release Form for the Use of Photos and Rights Ownership

I, , the parent or legal guardian of , hereby grant permission to Nakama BJJ Pty Ltd, to use photographs and/or videos taken of my child for social media purposes and marketing, and acknowledge and agree to the terms and conditions outlined in this waiver.

1. Consent for Use:
I understand and agree that Nakama BJJ Pty Ltd may use the photographs and/or videos taken of my child for promotional and marketing purposes, including but not limited to the organization's official website, social media platforms, brochures, flyers, advertisements, and any other marketing materials.

2. Ownership of Rights:
I acknowledge and agree that all rights, title, and interest in and to the photographs and/or videos, including any intellectual property rights, shall be owned solely and exclusively by Nakama BJJ Pty Ltd. I understand that I have no right or claim to ownership, copyright, or any other intellectual property rights in the photographs and/or videos.

3. Release and Waiver:
I release and discharge Nakama BJJ Pty Ltd, its officers, directors, employees, agents, representatives, and all persons acting under its permission or authority from any and all claims, demands, actions, causes of action, suits, damages, and liabilities, whether at law or in equity, arising from the use of the photographs and/or videos, including but not limited to any claims for defamation, invasion of privacy, right of publicity, or infringement of any intellectual property rights.

4. Confidentiality:
I understand and agree that while Nakama BJJ Pty Ltd will make reasonable efforts to maintain the privacy and security of the photographs and/or videos, they may be accessed by third parties on social media platforms or the internet. I acknowledge that Nakama BJJ Pty Ltd cannot guarantee the absolute privacy or confidentiality of the photographs and/or videos once they are shared publicly.

5. Revocability:
I understand that this consent and release is voluntary and that I may revoke it at any time by providing written notice to Nakama BJJ Pty Ltd. However, I acknowledge that revocation of consent does not affect any photographs and/or videos that have already been published or used by Nakama BJJ Pty Ltd prior to receiving my notice of revocation.

I have read this waiver and release form carefully and understand its contents. I agree that by signing below, I am waiving certain legal rights and voluntarily providing consent for Nakama BJJ Pty Ltd to use photographs and/or videos of my child for social media purposes and marketing, and acknowledging their ownership of the rights to such media.
